At LuxeVenue.ai, trust is the foundation of every celebration. This policy outlines how we collect, process, protect, and preserve your data with the same intelligence and care we bring to every event.

Data We Collect

We collect data necessary to facilitate luxury event planning, coordination, and intelligent delivery.

This includes:

Identity & Biometric Data

Name, email, phone, address, profile photos, biometric identifiers (facial recognition, if consented), KYC documentation, and identity verification records.

Event Metadata

Event type, guest counts, celebration dates, vibe preferences, vendor selections, multimedia uploads (photos/videos), AI-generated recommendations, and event analytics.

Financial & Transactional Data

Payment method details, escrow transaction records, invoice history, payment facilitation metadata, insurance policies, and financial audit trails.

Technical & Usage Data

IP address, device identifiers, browser type, operating system, session duration, 3D/VR walkthrough interactions, search queries, click patterns, and AI model training feedback.

Location Data

Approximate and precise location (GPS coordinates, city, venue proximity) for event planning, vendor matching, and logistics optimization.

AI Processing & Consent

LuxeVenue.ai uses artificial intelligence to enhance event discovery, vibe matching, vendor recommendations, and real-time coordination. This includes:

  • AI-Enabled Facial Recognition:If you upload guest photos or videos, our AI may analyze facial features to generate event memories, detect attendees, and improve Memory Vault organization.
  • Host as Data Fiduciary:When you upload third-party data (guest lists, photos, videos), you act as the Data Fiduciary. LuxeVenue.ai processes this data as a Data Processor on your behalf.
  • Neural Preference Mapping:We analyze your event choices, aesthetic preferences, and interaction patterns to build a personalized recommendation profile.
  • Anonymized Learning:We may analyze event data in anonymized or aggregated form to improve AI matching algorithms and platform intelligence. Individual identities are not disclosed.
Smart Consent Management

If you upload guest photos, videos, or personal data of third parties, you are responsible for obtaining appropriate consent from those individuals. You warrant that you have the legal authority to share this data with LuxeVenue.ai for event facilitation purposes.

Third-Party Data Disclosures & Ecosystem Integration

We share data only with trusted partners necessary to facilitate your event and maintain platform integrity:

  • Financial Services & Escrow:Banking partners, payment gateways, and escrow service providers for secure transaction processing and fund management.
  • Risk Management & Insurance:Insurance partners for Smart Shield coverage, claim facilitation, risk assessment, and policy underwriting.
  • Security & Compliance Audits:Verification providers, KYC/AML services, background check agencies, and security auditors.
  • Logistics & Experience Partners:Venues, vendors, artists, caterers, and service providers selected by you to execute your event.
  • Legal & Regulatory Authorities:Law enforcement, courts, tax authorities, and regulators where legally required or to enforce our rights.
No-Sale / Non-Commercial Guarantee

LuxeVenue.ai does not sell, rent, or license your personal data to third-party marketing agencies, advertisers, or data brokers. Your data is used solely for event facilitation, platform improvement, and legal compliance.

Data Security & The Memory Vault

We implement industry-standard security measures to protect your data:

  • AES-256 Encryption at Rest: All stored data is encrypted using military-grade encryption standards.
  • TLS 1.3 In Transit: Data transmission is secured with the latest transport layer security protocols.
  • Tier-4 Data Centres: Our infrastructure is hosted in certified, highly secure data centres with redundant systems.
  • Reasonable Security Practices: We comply with Indian DPDP Act requirements and implement Reasonable Security Practices and Procedures (RSPP).
  • VAPT & Continuous Auditing: Regular Vulnerability Assessment and Penetration Testing to identify and remediate security gaps.
Limitation of Liability

While we implement robust security measures, no system is 100% secure. We are not liable for breaches resulting from zero-day exploits, state-sponsored attacks, or user-side security failures (weak passwords, phishing, device compromise). Users are responsible for maintaining secure credentials and devices.

Data Retention & Right to be Forgotten

We retain your data only as long as necessary for the purposes outlined in this policy:

  • Subscription-Based Storage: Memory Vault content (photos, videos, event memories) is retained as long as you maintain an active subscription or until you request deletion.
  • Right to Erasure: You may request deletion of your personal data at any time by contacting our Data Protection Officer. We will process deletion requests within 30 days.
  • Statutory / Legal Overrides: We may retain data beyond your deletion request if required by law (tax records, audit trails, legal holds, ongoing disputes).
  • Financial Record Retention: Transaction records, invoices, and escrow history are retained for 7 years as per Indian financial regulations.
  • Audit Trail Retention: Security logs, compliance records, and access logs are retained for 2 years for security audits and regulatory compliance.
  • Automated Data Pruning: Inactive accounts may be automatically purged after 3 years of no activity, with advance notice sent to your registered email.

Incident Management, Breach Notification & Legal Immunity

In the event of a data breach that may compromise your personal information:

  • DPDP Breach Notification: We will notify affected users within 72 hours of discovering a qualifying breach, in compliance with Indian DPDP Act requirements.

  • Safe Harbor / Limitation of Liability: Our liability for breaches is limited to direct damages up to ₹5,00,000 per incident or the value of services paid by you in the last 12 months, whichever is lower.

  • User Contributory Negligence: We are not liable if the breach resulted from your failure to maintain secure credentials, falling for phishing attacks, or compromising your own devices.

  • Mitigation Efforts: We will take commercially reasonable steps to contain the breach, remediate vulnerabilities, and cooperate with law enforcement investigations.

  • Legal Jurisdiction: All breach-related disputes are subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India.

Cross-Border Data Transfers & International Users

LuxeVenue.ai is an India-based platform governed by Indian law:

  • Transfer/Storage on Indian Servers: All data is primarily processed and stored on servers located in India, subject to Indian data protection laws.
  • Consent to Data Transfer: By using LuxeVenue.ai, international users consent to the transfer and processing of their data in India.
  • Governing Law: This Privacy Policy and all data processing practices are governed by the Digital Personal Data Protection Act, 2023 (India) and applicable Indian laws.
  • Standard Contractual Safeguards: Where we engage international third-party service providers, we use standard contractual clauses and data processing agreements to ensure adequate protection.
  • Service Limitation: We do not guarantee compliance with GDPR, CCPA, or other non-Indian data protection regimes. International users accept Indian legal jurisdiction.
  • Informed Acknowledgment: By accessing our services from outside India, you acknowledge that your data will be subject to Indian laws, which may differ from your local jurisdiction.

Children's Privacy & Age Verification

  • 18+ Platform Restriction:LuxeVenue.ai is intended for users 18 years of age or older. We do not knowingly collect personal data from children under 18.
  • Parental/Guardian Consent Obligations:If you are a host planning events involving children (birthday parties, school events), you must obtain consent from parents/legal guardians before uploading any child-related data.
  • No Harmful Processing:We do not direct any AI profiling, vibe matching, or behavioral analysis toward children. Event memories involving children are stored securely in the Memory Vault.
  • Right to Deletion:Parents/guardians may request deletion of any child-related data by contacting our Data Protection Officer.

Consent Management & Right to Withdrawal

  • Right to Withdraw: You may withdraw your consent to data processing at any time by contacting privacy@luxevenue.ai or using in-platform consent management tools.
  • Consequences of Withdrawal: Withdrawing consent may limit your ability to use certain platform features (AI recommendations, vibe matching, Memory Vault, escrow services).
  • Non-Retroactive Effect: Withdrawing consent does not invalidate prior data processing activities conducted under valid consent.
  • Processing Timelines: Consent withdrawal requests are processed within 7 business days. Some data may be retained if required by law.
  • Ease of Withdrawal: We make withdrawing consent as easy as giving it. You can manage your preferences in Account Settings > Privacy & Data Controls.

Policy Evolution & Periodic Updates

  • Right to Modify: We reserve the right to modify this Privacy Policy at any time to reflect changes in our practices, services, legal requirements, or business operations.

  • What Changes Can Trigger Updates: New features (AI capabilities, 3D/VR enhancements), regulatory changes, security improvements, service expansions, or legal clarifications.

  • Notification of Material Changes: We will notify users of material changes via email or prominent in-platform notifications at least 30 days before the changes take effect.

  • Deemed Acceptance by Continued Use: Continued use of LuxeVenue.ai after the effective date of policy changes constitutes acceptance of the updated policy.

  • Archival Access: Previous versions of this policy are archived and available upon request to privacy@luxevenue.ai.
